1. What about the fundamental right to informational self-determination when it comes to GPS tracking?
2. Can I only use the product if I am the guardian of the person who is supposed to wear the insole?
In general, there are "recognized/approved" restrictions on the right to informational self-determination in the care sector, see also this article:

Basically, we can say from our experience with the soles used so far that the patients' freedom has actually been expanded when using the sole.
For example, in the case of patients who have already "lost themselves" in dangerous situations (at night/in cold weather/on large roads), so that they should actually be moved to a closed area so that they are constantly monitored. With the use of the sole, this "closed monitoring" could be replaced with an automatic SMS alarm to caregivers and relatives when the patient moves out of their "safe" zone.
There are now a whole series of rulings that ultimately focus on the purpose of tracking. If tracking is carried out for the purpose of supervision to ensure that the person can find their way/can be found if they get lost, then it can be legitimate to equip someone as a care representative, carer with the relevant responsibilities or with the consent of the person themselves with a tracking option, as long as this is not intended to permanently prevent someone from leaving, for example, the house.
The BIVA Pflegeschutzband has compiled the current judgments: https://www.biva.de/urteile/rechtsprechung-zu-ortungssystemen-fuer-demenzkranke/
If in doubt, it is advisable to contact the local guardianship court and ask about the usual practice.
3. Can the sole be worn throughout Europe or are there exceptions?
Technically speaking, the sole can be used anywhere in Europe and, after consultation and appropriate adaptation, also worldwide.
